Rental car damage claim in Portugal: what does the company have to prove?
In Portugal the rental company must first prove the car was damaged during your rental. Void clauses, return papers, card refunds and free arbitration.
Before the due date
- Object in writing before the deadline in the claim letter, disputing both liability and the amount, without paying or admitting fault, and keep proof of the date you sent it.
- Request in writing the check-out and return documents, dated photos and the itemised repair invoice or estimate: under art. 342(1) Código Civil the company must first prove the car was damaged while you had it.
- Check the return document the company had to hand you (DL 181/2012 art. 12(3)): acceptance without reservation, or no record of the car's condition at return, makes damage during your rental hard to prove.
Which law applies to a car rented in Portugal?
For a visitor who rents and drives only in Portugal, usually Portuguese law. Rome I art. 6(4)(a) removes the special consumer rule for services supplied “exclusively in a country other than” your home country, so the contract’s chosen law applies, or without a choice the law of the company’s seat (art. 4(1)(b)). Portuguese clause control covers companies established in Portugal “independentemente da lei escolhida pelas partes” (whatever law was chosen), art. 10(6) of Decreto-Lei 181/2012 in its 2012 text. Renting for “uso não profissional” (non-professional use) makes you a consumer (Lei 24/96 art. 2(1)).
Who has to prove the damage in Portugal?
The rental company has to prove first that the car deteriorated while you had it. Art. 342(1) of the Código Civil: “Àquele que invocar um direito cabe fazer a prova dos factos constitutivos do direito alegado” (whoever invokes a right must prove the facts it rests on). The Relação de Guimarães (2023) applied this to a vehicle: the lessor must “alegar e provar a perda ou deteriorações da coisa locada” (allege and prove the loss or damage to the rented item).
The second step is strict. Once deterioration is proven, art. 1044 makes the renter liable unless it results from a cause not attributable to them or to someone they let drive. The Supremo Tribunal de Justiça (21 November 2019) put the burden of disproving fault on the tenant. So most disputes turn on step one:
- Condition at pickup. Art. 1043(2) presumes the car was handed over in good condition when no document describes its state at delivery. That presumption is rebuttable (art. 350(2)), and dated photos and video are documentary evidence.
- Condition at return. If nobody recorded the condition when you handed the car back, and it was moved, re-rented or inspected later, damage during your rental is unproven and the presumption of fault never arises.
- Normal wear. Art. 1043(1) excludes “as deteriorações inerentes a uma prudente utilização” (deterioration inherent in prudent use).
Which rental clauses are void in Portugal (cláusulas abusivas)?
Standard terms are controlled by Decreto-Lei 446/85. The company must prove it communicated a clause (art. 5(3)); uncommunicated or hidden clauses drop out of the contract (art. 8), and prohibited clauses “são nulas” (are void, art. 12). For consumers the law bans clauses that:
- give the company the exclusive right to verify and establish the quality of the goods or service (art. 21(b)), such as its own inspection after you left;
- fix “indemnizações pecuniárias predeterminadas” (predetermined cash compensation, art. 21(d)), such as flat damage price lists;
- alter the allocation of risk (art. 21(f)) or “modifiquem os critérios de repartição do ónus da prova” (change the burden of proof, art. 21(g)), such as liability until a later unilateral inspection;
- set penalties out of proportion to the damage (art. 19(c)) or excessively high guarantees (art. 22(1)(m)), relevant for deposits.
The Supremo Tribunal de Justiça (27 April 2017) applied these rules to vehicle leasing. Lei 24/96 art. 9(2)(b) adds a ban on a “significativo desequilíbrio em detrimento do consumidor” (significant imbalance to the consumer’s detriment). DL 181/2012 art. 9(7) voids a waiver of your right to dispute the company’s expenses (b) and payment duties for expenses not “devidamente discriminadas e previstas no contrato” (duly itemised and provided for in the contract) (d). A court can reduce a “manifestamente excessiva” penalty (art. 812(1) Código Civil). The rental terms lookup shows which terms documents are on file.
What should happen when you return the car?
At return, the company must hand you a signed document declaring that the car was returned by you and accepted by the company (DL 181/2012 art. 12(3)). Ask for it every time. If the company signed acceptance without reservation, it becomes hard to show damage during your rental.
You are entitled to a written contract and a copy (art. 9(1) and (2)); companies keep contracts for two years (art. 14(1)). ECC-Net advises a joint inspection and photos at return. No statutory deadline for notifying damage was found. ECC-Net’s 2025 position paper proposes a 24-hour reporting window and says “Rental companies must bear the burden of proof”, but that is a policy proposal, not law.
How long can a rental company in Portugal claim damage?
Long: “O prazo ordinário da prescrição é de vinte anos” (the ordinary limitation period is twenty years, art. 309 Código Civil); tort claims expire after three years (art. 498(1)). Waiting will not end the claim, but the later a company inspects, the weaker its proof. You are only in default after a formal demand (art. 805(1)).
How much can the company charge?
Only damage actually caused: arts. 562 and 563 Código Civil cover damage the injured party “provavelmente não teria sofrido se não fosse a lesão” (probably would not have suffered without the injury). Where the exact amount is unclear, a court decides on equity within what is proven (art. 566(3)).
- VAT. For a VAT-registered claimant, deductible VAT “não corresponde a um efectivo prejuízo” (is not a real loss), Relação de Coimbra, 15 February 2022. On the other side, the Relação do Porto (14 January 2025) awarded repair value plus VAT without proof of payment for a car sold unrepaired, so an estimate is not automatically worthless.
- Loss of use. The Supremo Tribunal de Justiça (17 June 2021) presumed loss of use in a tort case where the car was in habitual daily use. No decision on a rental fleet was found, so ask for the calculation.
- Administrative fees. Only if itemised in the contract (DL 181/2012 art. 9(7)(d)) and proportionate (DL 446/85 art. 19(c)). No case law on them was found.
If you did cause the damage, this will not make the claim disappear, but the amount can still be checked: repair cost against estimate, fees, VAT, loss of use.
Fuel, cleaning and toll charges after return
Decreto-Lei 99/2026 of 22 May 2026 (in force 30 days after publication) keeps expenses tied to the contract’s itemised list, tolls excepted: the toll itself, not an administration fee on top. A fuel or charging fee must be proportional, the contract must state its maximum, and it “não pode, em caso algum, ultrapassar a média dos custos efetivamente incorridos” (may never exceed the company’s average actual refuelling or charging costs), art. 9(9) to (11). For companies contracting through websites or platforms the amended regime applies one year after entry into force, and older contracts are judged under the earlier text. Cleaning fees also need a basis in the contract and proof, such as interior photos.
The company charged your card after return: what now?
A deposit block is not consent to a later charge. Under PSD2 art. 75(1), funds may be blocked “only if the payer has given consent to the exact amount of the funds to be blocked”, and they must be released without undue delay once the amount is known.
- Refund request. If the authorisation did not specify the exact amount and the debit exceeded what you could reasonably expect (art. 76(1)), ask your bank within eight weeks; it must refund or give reasons within ten business days (art. 77). You carry the burden, and framework contracts can exclude this refund (art. 76(3)).
- Unauthorised debit. Under Decreto-Lei 91/2018 art. 112, notify your bank as soon as you become aware, and never later than 13 months after the debit.
- Chargeback. An ECC-Net report notes that consumers in Portugal may be entitled to a chargeback under national legislation even with a debit card, and observed a general time limit of three months.
Can they send you to collections or a credit register?
A rental invoice does not belong in Banco de Portugal’s credit register, which covers “operações de crédito” (credit operations) reported by supervised entities that grant credit (Instrução 21/2008). A clause requiring your consent to be listed in databases of defaulting customers is void (DL 181/2012 art. 9(7)(e)). A company can, however, use the injunção payment procedure (DL 269/98); never ignore one.
Complaints book, arbitration, free help and court
- Livro de Reclamações. The mandatory electronic complaints book; a complaint reaches the regulator. The AMT supervises rent-a-car contract clauses.
- Consumer arbitration. Under Lei 24/96 art. 14(2) and (3), claims up to the first-instance court threshold are subject to “arbitragem necessária ou mediação” (mandatory arbitration or mediation) at the consumer’s option. CACCL handles Lisbon-area disputes up to €5,000 (218 807 030, juridico@centroarbitragemlisboa.pt). CNIACC covers areas without another centre (253 619 107, geral@cniacc.pt).
- ECC Portugal. Free help for cross-border cases: +351 21 356 47 50, euroconsumo@dg.consumidor.pt (Eurocid).
- ECRCS. Free conciliation for cross-border EU or UK rentals once the company’s own procedure is exhausted, within 12 months of its final response; rulings bind participants (Avis Budget, Enterprise, Europcar, Hertz, Sixt).
- Court. If you live in another EU country and the company directs its activities there, it can sue you only in your home country’s courts, and you may sue it there (Brussels I recast arts. 17(1)(c) and 18).
What to do now
- Object in writing; a clause waiving your right to dispute expenses is void.
- Request the signed contract with itemised expenses and fuel maximum, the check-out and return documents, dated photos, and the itemised repair invoice or estimate.
- If your card was debited, contact your bank now (eight weeks, 13 months).
- File in the Livro de Reclamações, then consider arbitration, ECC Portugal or ECRCS.
Before you reply, the free Claim Check shows where the claim is weak and which deadlines apply; the five-question self-check is a quick first test.

Questions
Does the rental company have to prove the damage in Portugal?
Yes, as a first step. Under art. 342(1) Código Civil the company must prove the deterioration during the rental. Once that is proven, art. 1044 presumes the renter responsible unless the cause was not attributable to them, so the pickup and return records usually decide the case.
Can a Portuguese rent-a-car company charge damage found after I returned the car?
It can try, but it still has to prove the damage happened during your rental. If the condition at return was not recorded and the car was moved, re-rented or inspected later, that proof is missing. A clause keeping you liable until a later unilateral inspection can be challenged under art. 21(g) of Decreto-Lei 446/85.
Is a flat damage price list valid in Portugal?
In consumer contracts, Decreto-Lei 446/85 prohibits clauses that fix predetermined cash compensation (art. 21(d)) and penalties out of proportion to the damage (art. 19(c)). Prohibited clauses are void (art. 12). A court can also reduce a manifestly excessive penalty under art. 812 Código Civil.
What can I do if the rental company already charged my card?
A deposit block under PSD2 art. 75 is consent to block an exact amount, not to a later charge. If the debit exceeded what you could reasonably expect, you can ask your bank for a refund within eight weeks. An ECC-Net report notes that consumers in Portugal may be entitled to a chargeback under national law even with a debit card.
Where can I complain about a rental company in Portugal for free?
You can file in the electronic Livro de Reclamações, go to a consumer arbitration centre such as CNIACC or CACCL (Lisbon area, up to €5,000), or contact ECC Portugal. For cross-border rentals with Avis Budget, Enterprise, Europcar, Hertz or Sixt, the ECRCS conciliation service is free within 12 months of the company's final response.
