How do I dispute a Drivalia damage claim?
Drivalia's Italian contract promises photos and an independent appraisal by email before a damage charge. The UK terms add an £80 admin fee. Check both.
Before the due date
- Reply in writing to Drivalia's damage email before the deadline in the claim letter, quoting the contract number and disputing both the damage and the amount, without paying or admitting anything.
- Ask Drivalia for the check-in report with signature and time, the original photos with metadata, the appraisal report, the repair invoice and, after an out-of-hours return, a record of who moved the car.
- Check whether Drivalia emailed you the photos and the independent appraisal and invited your comments before charging your card, which is the order its Italian contract sets.
How Drivalia handles damage found after return
Drivalia records the car’s condition in a check-in report at return and, in Italy, sends you photos and an independent appraisal before it charges your card. (If damage is found at return, the company informs you by email with the photos and an appraisal issued by an independent certification body, and invites your comments.) After that, Drivalia charges the amount under letter F of the contract to your credit card, “salvo che il cliente non provi che il danno sia derivato da causa a lui non imputabile come previsto dall’art 1588 c.c.” (unless you prove the damage came from a cause not attributable to you, as provided by article 1588 of the Italian Civil Code).
In the UK the process is shorter on paper: repair costs plus a fixed fee. “An admin fee of £80.00 will be applied in case of any damage to the vehicle in addition to the repair costs.” Drivalia UK rental terms
What Drivalia’s terms say, country by country
Italy. At return you must ask a Drivalia employee to sign the check-in report showing the car’s condition. The contract adds: “In assenza di suddetta firma, saranno valide e tacitamente accettate le determinazioni documentate dalla DRIVALIA.” (Without that signature, the findings documented by Drivalia are valid and tacitly accepted.)
All published rates include the CDR damage service. The contract says “Il servizio CDR non è una copertura assicurativa” (the CDR service is not insurance). It caps what you pay per event “da un minimo di euro 1200,00 ad un massimo di euro 3500,00” (from €1,200 to €3,500) by car group. It excludes glass, roof, underbody, wheels, interior and vandalism. The optional Super Cover removes the amount, including those parts.
None of the services apply in cases of wilful misconduct or gross negligence, lack of diligence, failure to return keys and vehicle, or an unauthorised driver. Accidents and damage must be reported in writing “entro 24 ore dall’ evento o al momento del rientro del veicolo” (within 24 hours of the event or at return). Otherwise a penalty of €500 to €2,000 applies.
Charges may also include “le eventuali spese di apertura pratica sinistro” (any claim file opening costs), without an amount. The exclusive venue is Civitavecchia, but the clause does not apply to consumers.
Spain and France. The rental contract pages on Drivalia’s Spanish and French sites showed the same Italian-language contract of DRIVALIA S.p.A. It even says the car may never be returned outside Italy. Ask for the contract you signed locally before relying on these clauses.
United Kingdom. The terms apply only to bookings made on drivalia.co.uk. Collision Damage Waiver “limits the driver’s liability (excess) up to £2,500”, which you can reduce to £900, £450 or zero. Your deposit equals your excess and starts from £1,500. Negligent damage is excluded: “you will be responsible to pay the full amount of the damage, regardless of the excess reduction package purchased.” The terms add that “Each case will be subject to internal investigation and determined on their individual merits.”
An out-of-hours return costs £40 and is only possible at locations that offer it. Extra cleaning is capped: “a valeting fee of £150 maximum will apply.” Unpaid charges go to debt recovery with a £50.00 admin fee.

Where Drivalia damage claims are often weak
These checks only help if you did not cause the damage. If you did, the amount can still be checked: repair invoice or appraisal, the fees, VAT and loss of use.
1. The custody gap. In Italy, an unsigned check-in report lets Drivalia’s own findings stand. Check whether a report exists, who signed it and when. The UK terms allow out-of-hours returns at some locations but do not say when the car is inspected, so ask for the inspection time.
2. Photos without metadata. The Italian contract promises photos by email. Check whether you received original files with date, time and location, and whether they match your return time and place.
3. An estimate instead of an invoice. An appraisal is not a repair bill. Check whether the Italian charge stays within your CDR cap and whether the damaged part is excluded from CDR. In the UK, ask for the repair invoice behind the repair costs.
4. Fees above their own price list. The UK admin fee is £80.00 and valeting is capped at £150. Check both. For claim file opening costs in Italy, ask which published price list sets the amount.
5. Their own terms against them. The Italian contract sets an order: photos and appraisal by email, your comments, then the charge. Check whether your card was debited before you had a chance to respond. In the UK, ask for the result of the “internal investigation” if negligence is alleged.
How to respond to a Drivalia damage claim
- Do not pay and do not admit anything. Do not sign a damage acknowledgement at the desk or by email.
- Dispute in writing. Reply to the damage email, quote the contract number and state that you dispute the damage and the amount. In Italy, use the invitation to comment the contract gives you.
- Request the evidence a solid claim would have. Ask for the check-in report with signature and time, the original photos with metadata, the full appraisal report, the repair invoice and, for an out-of-hours return, a record of who moved the car after drop-off.
- Check the card debit. Compare it with your deposit, your CDR cap or excess, and the invoice. If a charge went through before you saw the evidence, tell your card issuer in writing.
- Keep everything dated. Keep the contract, the booking confirmation, every email and your own pickup and return photos.

Questions
Can Drivalia charge my credit card for damage after I returned the car?
Yes, its contracts allow card charges. The Italian contract says Drivalia first emails the photos and an appraisal by an independent certification body and invites your comments, then charges the card. Check whether you received both before the debit, and dispute in writing if not.
What is Drivalia's damage admin fee?
The UK rental terms apply an admin fee of £80.00 for any damage to the vehicle, in addition to the repair costs. The Italian contract lists possible claim file opening costs among the charges but gives no amount, so ask which price list applies.
How much do I pay for damage with Drivalia's basic cover in Italy?
The Italian contract includes a CDR damage service in all published rates. It is not insurance but a contractual cap per event of €1,200 to €3,500 depending on the car group. It does not cover glass, roof, underbody, wheels, interior or vandalism, and it does not apply in cases such as gross negligence or an unauthorised driver.
What happens if I do not get the Drivalia return report signed?
The Italian contract obliges you to ask a Drivalia employee to sign the check-in report at return. Without that signature, the findings documented by Drivalia count as tacitly accepted. If you could not get a signature, record your own return photos and write to Drivalia straight away.
Do Drivalia's Spanish and French pages have their own rental contract?
When we read them, the rental contract pages for Spain and France displayed the same Italian-language contract of DRIVALIA S.p.A. as the Italian site. If you rented in Spain or France, ask Drivalia for the contract you actually signed and check which company and terms it names.
