Rental car damage claim: your options compared
Dispute it yourself, RentalProof, a lawyer, ECRCS, a European Consumer Centre, a chargeback, excess cover or a pickup app: cost, speed, limits.
Which option fits your rental car damage claim?
It depends on three things: whether you caused the damage, where you rented, and how far the dispute has gone. Almost every route starts the same way, with a written dispute to the rental company, because the free bodies and banks expect you to have tried that first.
One honest point before comparing: disputing liability only helps when you did not cause the damage. If you did, the amount can still be checked, for example a repair estimate billed as if it were an invoice, flat fees, VAT or loss of use.
1. Can I write the dispute myself?
Yes, and it costs nothing. You write to the company, reject the claim, and ask for the evidence a solid claim needs: the check-out and return reports, original photos with their dates, the repair invoice rather than an estimate, and the clause in their terms the fee rests on.
What it needs from you: time, the rental documents, and some knowledge of the law in the pickup country. The country guides summarise the rules, and the rental terms lookup shows the terms documents on file by company and country.
The limit is precision. A letter that argues in general terms is easy to answer with a standard reply. A letter that names the missing documents, the date in the photo that does not fit and the clause that does not cover the fee is much harder to ignore.
2. What does RentalProof do and what does it cost?
RentalProof helps renters dispute unjustified damage claims and after-return charges such as fuel, cleaning or admin fees, for rentals in Germany, Austria, France, Italy, Spain, Portugal, Greece, Croatia, the United Kingdom and Switzerland.
- Free Claim Check: upload the claim and get a weakness report, the next three steps and a deadline check.
- Dispute Kit, €49: forensics of the photos, metadata, dates, tariffs and the company’s own terms; a legal check against verified statutes and cases renters have won; a dispute letter in their language and yours, checked by a person; an evidence pack; a chargeback kit; an escalation plan.
- Kit + Human review, €89.
- Lawyer letter via a partner law firm, from €199.
RentalProof is not a law firm. The documents go out in your own name, and it is independent of every rental company. The founder, Sascha Heyer, had a €1,320 Sixt key-box claim in Graz cancelled within 24 hours; his story is here.
3. When does a lawyer make sense?
A lawyer fits once the dispute leaves the letter stage: a court claim has been filed, you received a payment order with a short objection deadline, or the amount is high and the facts are genuinely contested. A lawyer can also represent you in court, which none of the other options here do.
Within the EU, jurisdiction often works in your favour. Under Articles 17(1)(c) and 18(2) of the Brussels Ia Regulation, a consumer can be sued only in the member state where they live, so a rental company that goes to court has to do so in your home country.
Check first whether you already have help: legal expenses insurance, or member legal aid from a motoring club such as ADAC or ÖAMTC. If you want a lawyer’s letterhead without full representation, RentalProof’s partner law firm offers a lawyer letter from €199.
4. Can the European Car Rental Conciliation Service help?
Yes, if three conditions from its FAQ are all met: the company is a member, the rental was cross-border, and you have already had the company’s final decision. The service is free.
On the rental, the FAQ is precise: “you must be a resident of the EU or UK and the rental must have taken place in a different EU country.” The members listed are Alamo Rent A Car, Avis Budget Europe, Dollar Europe, Budget Europe, Enterprise Europe, Europcar Europe, Hertz Europe, National Car Rental, Sixt Europe, Thrifty Europe and Firefly Europe. Companies not on that list are not bound by the service.
- Time limit: within 12 months of the company’s final response, according to the FAQ. File as soon as you have that answer.
- Duration: it aims to resolve complaints within 30 working days.
- Outcome: if it finds in your favour, the company is told to refund unjustified charges within 10 working days, and the FAQ states: “The rental company must comply with the rulings of the ADR service.” You can still go to court if you disagree.
- Limits: it does not take cases where court proceedings, another ADR procedure or a bank or card investigation have already started; it is “not qualified to adjudicate on the repair method or cost of a repair”; and it awards no compensation for losses or inconvenience.
5. Will my European Consumer Centre take the case?
Often, if the rental company is based in another country. The European Consumer Centres Network has 29 centres in every EU member state, Norway and Iceland, and helps EU residents with cross-border disputes free of charge, out of court.
The rules of the German centre show what to expect. You must live in Germany; the company must be in another EU country, Iceland, Norway or the United Kingdom; you must have complained in writing and given the company at least four weeks. The current wait for a first reply is 12 weeks on average, the centre has no enforcement powers, and its involvement does not stop the limitation period.
A centre in your own country will not act against a company based there, and for a Swiss rental company the network does not apply.
6. Should I dispute the debit with my bank?
If money has already left your card, the bank route runs in parallel with the letter. Two different rules apply.
The legal rule is the EU payment services directive. A payment counts as authorised only if you consented to it (Article 64). For an unauthorised or incorrectly executed transaction, Article 71(1) sets the deadline: you must notify your bank “no later than 13 months after the debit date.” A debit for an item the rental agreement does not provide for, or above what you agreed to, can be disputed on this basis.
The chargeback itself follows card-scheme rules, not law. According to the German European Consumer Centre, schemes usually allow up to 120 days, mostly counted from the debit date, and the merchant can object. Remember the ECRCS exclusion above before you open a card dispute.
7. Does excess reimbursement insurance solve the problem?
It pays, it does not argue. A standalone excess policy reimburses the excess after the rental company has charged it. Questor describes its product this way: the “policy reimburses you should you damage the car and have to pay the car hire company an excess” (Questor).
Three points follow from that page and the claims page. Cover must exist before the rental starts. A claim needs the rental agreement, the damage report or photos and proof that you paid. And the insurer’s own deadline applies, for Questor 30 days from becoming aware of the incident. A disputed or inflated claim is still worth contesting: the policy limit is finite and the insurer only reimburses what you actually paid.
8. Do evidence apps at pickup help?
Yes, but they work before a claim exists. Photos taken at pickup and return are the evidence every later option relies on.
The free RentalProof app guides you around the car at pickup and return and seals every photo with a server timestamp and a hash on upload, so nobody can question when it was taken. Ordinary phone photos help too, as long as you keep the original files: the time and place inside them are the evidence. If a claim arrives, those photos go straight into the dispute.

When RentalProof is not the right choice
- You caused the damage and only want to pay less. A dispute letter rejecting liability is the wrong tool. Check the amount instead, and consider negotiating directly or using your excess cover.
- A court case has already been filed. Take the court papers to a lawyer. Deadlines in court proceedings are strict.
- The rental was outside the ten covered countries. RentalProof’s legal check is built on the law of Germany, Austria, France, Italy, Spain, Portugal, Greece, Croatia, the United Kingdom and Switzerland.
- You are dealing with injuries or a third party. That belongs with your motor or liability insurer and, if needed, a lawyer.
What to do next
Do not pay and do not admit anything on the phone. Note every deadline in the claim, then answer in writing. If you are unsure how strong the claim is, the five-question self-check gives a first idea, and the free Claim Check shows the weaknesses and the next three steps for your specific case before you decide which of the routes above to take.
Questions
What is the cheapest way to fight a rental car damage claim?
Writing the dispute yourself, your European Consumer Centre and the ECRCS cost nothing. The free options have conditions: ECRCS only handles its member companies and cross-border rentals after the company's final answer, and ECC-Net only helps with a trader in another country. A written dispute to the company comes first in every case.
Can I use ECRCS and a chargeback at the same time?
Not easily. The ECRCS FAQ lists complaints where an investigation via your bank or credit card provider has started among the cases it does not take. If you want conciliation, decide on the order before you open a card dispute.
How long do I have to dispute a rental car debit with my bank?
Under Article 71(1) of the EU payment services directive you must notify your bank without undue delay and no later than 13 months after the debit date for an unauthorised transaction. Card-scheme chargebacks have their own, shorter limits; the German European Consumer Centre says schemes usually allow up to 120 days.
Does excess reimbursement insurance dispute the claim for me?
No. A standalone excess policy reimburses you after you have paid the rental company's excess. Questor's claims page, for example, asks for the rental agreement, the damage report or photos and proof of payment. Whether the damage claim was justified is not something the policy argues for you.
When should I hire a lawyer for a rental car damage claim?
When the company has filed a court claim, when you received a payment order with a short deadline, or when the amount is high and the facts are contested. RentalProof's partner law firm offers a lawyer letter from €199; for full representation, check whether you have legal expenses cover or motoring club legal aid.
Is RentalProof a law firm?
No. RentalProof is software that prepares documents you send in your own name. It is independent and not affiliated with any rental company. A letter from a lawyer is available through a partner law firm from €199.
