How do I dispute an Avis damage claim?

Avis country terms for Germany, Austria, Spain and Italy set fixed damage fees and caps. Check your Avis damage charge against them before you pay.

Before the due date

  1. Dispute both liability and amount in writing before the deadline in the claim letter, using the customer service address in your country's Avis conditions (Germany: de.aviscustomercare@abg.com), without paying or admitting fault.
  2. Ask Avis in writing for the pickup and return records, the original photos with metadata, the repair invoice rather than only an estimate, any appraisal, and the car's movement log after your return.
  3. Check each fee against Avis's own country figures (€30.00 in Germany and Austria, €45.98 plus €56.87 in Spain, €123.12 downtime in Italy) and dispute anything above your excess if you had a waiver.

How Avis handles damage found after return

Avis charges damage it finds after the rental directly, usually to the payment card you rented with. The Avis Spain conditions say it plainly: “Si encontramos algún daño, cargaremos el importe que tiene que pagar en su tarjeta” (if we find any damage, we charge the amount you have to pay to your card). The Avis Italy conditions use almost the same sentence, and the Avis Germany conditions say the amount is charged on the rental agreement: “Wenn wir einen Schaden feststellen, werden wir Sie mit dem Betrag, den Sie zahlen müssen, auf dem Mietvertrag belasten” (Avis Germany).

The card is prepared for this at pickup. Germany, Austria and Italy all require a pre-authorisation on your payment card before the car is handed over. The Avis UK booking conditions explain that a pre-authorisation “holds an amount of money in your account” and that releasing it can take up to 14 days (Avis UK).

What the Avis country conditions for Germany, Austria, Spain and Italy do not contain is a described return inspection, a key-box return rule or a deadline for telling you about damage. That makes the paperwork from your own return, and the date the damage was first recorded, the first things to ask for.

What Avis’s terms say, country by country

Germany. Without a damage waiver you pay, if you are responsible for the damage (“sofern Sie dies zu vertreten haben”), the cheaper of replacement or estimated repair cost, plus loss of use, plus a handling fee. With a waiver, your share is capped at the excess on your rental agreement: you pay the repair or replacement cost plus a €30.00 handling fee, or the excess, whichever is lower. If the damage was caused intentionally or through gross negligence, Avis may claim “in einem der Schwere des Verschuldens entsprechenden Umfang” (in proportion to the degree of fault) up to the full damage, and the conditions add that you carry the burden of showing there was no gross negligence. In Germany the rental company has to prove the damage happened during your rental, see the Germany guide.

Austria. The Austrian conditions are issued by Avis Autovermietung GmbH in Vienna. With a waiver: “Sie zahlen den entstandenen Schaden plus eine Schadens-Bearbeitungsgebühr von € 30,00 oder Sie zahlen den vereinbarten Selbstbehalt, je nachdem welcher Betrag geringer ist” (you pay the damage plus a €30.00 handling fee, or the agreed excess, whichever is lower). The waiver does not apply to intentional or grossly negligent damage. Damage and accidents have to be reported on a damage report form within seven days at the latest (Avis Austria). The same burden of proof point applies, see the Austria guide.

Spain. The Spanish conditions put the burden the other way round: you pay “salvo que pueda demostrar que los daños no se han debido a su culpa o a su negligencia” (unless you can show the damage was not due to your fault or negligence). Without a waiver that means the cheaper of replacement or estimated repair cost, plus loss of use, plus an administrative charge. With a waiver you pay the repair or replacement cost plus a €45.98 damage handling fee plus €56.87 for vehicle downtime, or the excess, whichever is lower. The waiver does not reduce the amount if you drove without the necessary care and attention (Avis Spain). Legal background: Spain guide.

Italy. Without a waiver you pay the lower of replacement or estimated repair cost plus a flat downtime charge: “Fermo Tecnico del veicolo calcolato in €123,12 (IVA e supplemento aeroporto/città inclusi) a prescindere dalla durata del fermo e dalla categoria del veicolo” (downtime charged at €123.12 including VAT and airport or city surcharge, regardless of how long the car is off the road or its category). With a waiver you pay the lower of the liability cap on your contract and the repair cost. The Italian waiver lapses for damage caused deliberately or “per incuria” (through carelessness) and for interior, roof, clutch, over-revving, tyre, rim and underbody damage (Avis Italy). Legal background: Italy guide.

United Kingdom. The Avis UK document on file is the booking conditions, not the full rental agreement. It says the rental agreement “is governed by the law of the country where you pick-up the vehicle”, and that Avis is a member of the European Car Rental Conciliation Service (ECRCS), which reviews disputes “with no additional cost to you”. Legal background: United Kingdom guide.

Where Avis damage claims are often weak

  • The custody gap. None of the four country conditions describes how or when the car is inspected after return. Check whether the claim shows a return record signed or dated at handover, or whether the damage was only noted later.
  • Photos without metadata. Check whether the photos carry the original date, time and location, and whether any show the car at pickup for comparison.
  • An estimate instead of an invoice. Germany, Spain and Italy base the no-waiver charge on “estimated” repair cost, and the waiver rules speak of the cost of the repair. Check whether you received an actual repair invoice and whether the “cheaper of replacement or repair” rule was applied.
  • Fees above their own price list. Check each fee against the country figure: €30.00 in Germany and Austria, €45.98 plus €56.87 in Spain, €123.12 downtime in Italy, and whether the total respects the “whichever is lower” cap at your excess.
  • Their own terms against them. In Germany the no-waiver charge applies only if you are responsible for the damage. Check whether the claim explains why you are.

The method helps when you did not cause the damage. If you did, the amount can still be checked: repair invoice against estimate, the fees, VAT and loss of use.

How to respond to an Avis damage claim

  1. Do not pay and do not admit anything on the phone or by email while you check the claim.
  2. Dispute it in writing to the customer service address in your country’s conditions (Germany: de.aviscustomercare@abg.com), stating that you do not accept the charge.
  3. Request the evidence a solid claim would have: the pickup and return records, the original photos with metadata, the repair invoice (not only an estimate), any appraisal, and the car’s movement log after your return.
  4. Check the card debit against the fees and caps above, and dispute any amount above your excess if you had a waiver.
  5. Escalate if needed. The Avis Germany conditions name the Allgemeine Verbraucherschlichtungsstelle des Zentrums für Schlichtung e.V., the Austrian conditions the Schlichtung für Verbrauchergeschäfte, and Avis names ECRCS.

What to do next

Keep the claim letter, your rental agreement and any photos from pickup and return together. If Budget was the brand on your contract, read the Budget page, since both brands often share group terms. To see how strong your Avis claim is before you reply, upload it to the free Claim Check: you get a weakness report, the next three steps and a deadline check. Every document on file for Avis is also listed in the rental terms lookup.

Questions

Can Avis charge my card for damage after I returned the car?

Yes, the terms allow it. The Avis Spain and Avis Italy conditions say that if Avis finds damage, it charges the amount to your card, and the Avis Germany conditions say the amount is charged on the rental agreement. A debit is not the end of the matter: you can contest it in writing and ask for the evidence behind it.

What is Avis's damage handling fee?

It depends on the country. With a damage waiver, the Avis Germany and Avis Austria conditions name a fee of €30.00, and you pay the damage plus that fee or your excess, whichever is lower. Avis Spain names €45.98 plus €56.87 for vehicle downtime, again capped at the excess. Avis Italy charges a flat €123.12 downtime fee if you have no waiver.

Does the Avis damage waiver cover every kind of damage?

No. In Austria the waiver does not apply to damage caused intentionally or through gross negligence, and in Germany Avis may then claim up to the full damage in proportion to the degree of fault. In Spain the amount is not reduced if you drove without due care. The Avis Italy conditions exclude interior, roof, clutch, tyres, rims and underbody damage from the waiver.

Who has to prove the damage, me or Avis?

In Germany and Austria the rental company has to prove the damage happened during your rental, see the country guides. The Avis Spain and Avis Italy conditions say you pay unless you can prove the damage was not your fault, so in those countries a clear pickup and return record matters even more.

Where can I complain about an Avis damage charge?

Write to the customer service address in your country's conditions first, for Germany de.aviscustomercare@abg.com. Avis says it is a member of the European Car Rental Conciliation Service (ECRCS), which reviews disputes at no extra cost, and the German and Austrian conditions also name a national consumer conciliation body.

Are Avis and Budget terms the same?

Often they come from the same group. The Avis Germany conditions refer to Avis/Budget and name Avis Budget Autovermietung GmbH & Co. KG as the rental company, and in Spain Budget is a business line of the same company that runs Avis. Always read the document for the brand and country on your rental agreement.
