Rental car damage claim in Greece: what the company has to prove

Charged for damage after returning a rental car in Greece? The company must prove the damage and the amount, and has six months from the return to claim.

Before the due date

  1. Dispute the claim in writing before the deadline in the claim letter, contesting both liability and the amount, without paying or admitting fault, and keep proof of the date you sent it.
  2. Ask in writing for the check-out and check-in records, time-stamped photos, the itemised invoice and proof of repair: the company must prove the damage was caused during the rental and its amount (ΑΠ 1399/2019).
  3. Write down the date you returned the car: under Civil Code art. 602 the company's damage claim becomes time-barred six months after it took the car back, not six months after its invoice.

Which law applies to a car rented in Greece?

In practice, Greek law. The EU consumer rule on applicable law excludes services “to be supplied to the consumer exclusively in a country other than that in which he has his habitual residence” (Rome I, art. 6(4)(a)). A holiday rental driven only in Greece follows the law chosen in the contract or, failing that, the company’s home law: Greek law for a Greek branch.

Law 2251/1994 controls the general terms of contracts concluded in Greece, and the rent-a-car business has its own rules in joint ministerial decision 16597/2010. The company must sign a written contract in two copies, one of which stays with the car, stating the agreed price, the vehicle and plate, and the rental period (decision 16597/2010, art. 7(3)).

Who has to prove the damage?

The rental company. The Greek Supreme Court (Areios Pagos) holds that a lessor claiming for damage must allege and prove the damage and the amount of the loss, “όχι, όμως, και την κατάσταση του μισθίου στην έναρξη της μίσθωσης” (but not the condition of the rented item at the start of the lease) (ΑΠ 1399/2019). ΑΠ 985/2020 says the same: the lessor proves the contract, the damage and the amount.

Once that is shown, you have to show that the damage comes from the agreed use, from an event you are not responsible for, or from force majeure. The Civil Code, as recited by the court, does not make the renter liable for wear that results from agreed use.

In practice:

  • The company needs no pickup report. Your own dated pickup photos can show that a mark was already there.
  • What the company must prove is damage caused “κατά τη διάρκεια της μίσθωσης” (during the rental). Time-stamped photos at return show the state in which you handed the car back.

This only helps if you did not cause the damage. If you did, the amount can still be checked: repair invoice against estimate, fees and loss of use.

Can the rental terms make you liable anyway?

Not freely. Under Law 2251/1994 art. 2(6), terms that create a significant imbalance of rights and obligations to the consumer’s detriment “απαγορεύονται και είναι άκυροι” (are prohibited and void) (Law 2251/1994, art. 2). Art. 2(7) lists terms that are abusive in any event, among them terms that:

  • let the company decide on its own whether its performance matches the contract (item ζ);
  • confirm that you know the condition of the goods when you actually do not (item κδ), such as a pre-printed “no damage” line you never had the chance to check;
  • reverse the burden of proof against the consumer (item κζ).

General terms also do not bind you if you were unaware of them through no fault of your own, in particular when the company did not point them out or did not let you actually read them (art. 2(1)). Terms of contracts concluded in Greece must be written in Greek, clearly, specifically and legibly (art. 2(2)), and terms drafted by the company are read in the consumer’s favour in case of doubt (art. 2(4)). If a clause is abusive, the rest of the contract stands (art. 2(8)).

The limits: these rules do not erase a condition report you actually checked and signed, and a term individually negotiated at the desk is harder to attack than a printed clause.

What if nobody inspected the car at return?

Then the company may struggle to prove its case. We found no Greek rule requiring a written condition report at pickup or return, so the evidence each side holds decides. ECC-Net advises inspecting the car together with staff and taking photos at return (ECC-Net).

Think of an island rental returned at a port or airport before an early ferry or flight. If you dropped the keys in a box, if nobody checked the car with you, if the car was moved or rented out again before the inspection, or if the damage report was written days later, “during the rental” can remain unproven. Without that, the burden never passes to you.

How long does the company have to claim?

Six months from the return. Civil Code art. 602: “Οι αξιώσεις του εκμισθωτή για αποζημίωση εξαιτίας μεταβολών ή φθορών στο μίσθιο παραγράφονται ύστερα από έξι μήνες αφότου το ανέλαβε.” (The lessor’s claims for compensation for changes or deterioration of the rented item become time-barred six months after it took the item back.) (ΑΚ 602). The clock starts on the day the company actually took the car back, not on the invoice date. In ΑΠ 777/2022 the Supreme Court held a claim brought later than that time-barred.

One caveat: in ΑΠ 482/2012 the six months applied to physical deterioration, while a claim framed as breach of the duty to return the item in the condition received fell under a twenty-year period. A scratch, dent or broken part is physical deterioration.

How much can they charge for the damage?

Only what they prove. As applied by the Supreme Court, the renter owes actual and consequential loss caused by the damage, and for a destroyed or removed part the replacement cost. The company must prove the amount. Ask for:

  • the itemised repair estimate or invoice;
  • proof that the repair was actually carried out;
  • the car’s damage history, to see whether the same damage was already on record.

For flat damage price lists, administrative fees and loss-of-use charges we found no verified Greek decision on rental cars. They can be tested against art. 2(6) and (7) of Law 2251/1994, and you can demand the calculation behind each figure.

Fuel, cleaning and admin fees after return

Greek rent-a-car companies submit their prices for approval each year, and “Ο θεωρημένος τιμοκατάλογος αναρτάται σε εμφανές σημείο του καταστήματος” (the approved price list is posted in a visible place in the office) (decision 16597/2010, art. 7(1)). Breaches of the decision carry a fine of €300, rising to €600 and €900 on repetition (art. 10), so a fee outside the contract and the approved list is also a matter for the tourism authority.

Three checks apply to any extra charge:

  • Express consent. Law 2251/1994 art. 4στ requires the company to seek “τη ρητή συναίνεση του καταναλωτή για κάθε πρόσθετη πληρωμή” (the consumer’s express consent to every additional payment). Where consent came from pre-selected options you had to reject, you are entitled to a refund (art. 4στ).
  • A price you can work out. Art. 2(7)(ια) treats as abusive terms that leave the price open without good reason and without criteria set in the contract.
  • Proof of the fact. For fuel, ask for the check-out and check-in readings, the fuel receipt and the calculation. For cleaning, time-stamped check-in photos and the cleaning invoice. For a fine or toll handling fee, the notice itself, the company’s letter naming you to the authority and the invoice for the fee. A damage-handling fee falls if the damage claim fails.

Your card was charged after return

A pre-authorisation at pickup is consent to block that amount, not consent to a later charge of a different amount (PSD2). Greece transposed PSD2 in Law 4537/2018 with the same article numbers.

  • Refund request (arts 76 and 77). Within eight weeks of the debit, for a payment initiated by the company whose exact amount was not specified and which exceeded what you could reasonably expect. The bank refunds or gives reasons within ten business days. You have to show the amount went beyond what you could expect.
  • Unauthorised debit (arts 71 to 73). Notify your bank without undue delay and at the latest within thirteen months. The bank has to prove the payment was authenticated, and it refunds an unauthorised payment by the end of the next business day at the latest (art. 73).

Letters or calls from a debt agency

Greek debt-information companies may phone only ten days after the debt fell due, “από τις 9:00 έως 20:00 και μόνο τις εργάσιμες ημέρες” (from 9:00 to 20:00 and only on working days) (Law 3758/2009, art. 4). They inform and negotiate but are not allowed to collect the debt, and their fees cannot be charged to you.

  • European Consumer Centre of Greece, part of the Ombudsman: +30 210 6460814, info@eccgreece.gr (eccgreece.gr). If you live in another EU country, your home European Consumer Centre handles exactly this kind of cross-border case, free.
  • ECRCS, free for cross-border rentals once the company’s complaint procedure is exhausted, within 12 months of its final response. Rulings bind Avis Budget, Enterprise, Europcar, Hertz and Sixt (ECRCS).
  • Court. Claims up to €5,000 before the Ειρηνοδικείο (magistrates’ court) follow the small-claims procedure (ΚΠολΔ art. 466). A consumer domiciled in the EU may sue at home and may be sued only at home (Brussels I recast, art. 18).

What to do now

  1. Write down the date you returned the car and the date six months later.
  2. Ask the company in writing for the contract with the agreed price, the check-out and check-in records, time-stamped photos, the itemised invoice and proof of repair.
  3. Keep your own photos, the return receipt and your card statement, and note the card deadlines above.
  4. Compare the charge with the terms on file and try the five-question self-check.

Before you reply, the free Claim Check shows where the claim is weak, the next three steps and your deadlines.

Questions

Who has to prove the damage on a rental car in Greece?

The rental company. The Greek Supreme Court requires the lessor to prove the damage caused during the rental and the amount of the loss. It does not have to prove the condition at pickup. Once the damage is proven, the renter has to show agreed use, an event outside their responsibility or force majeure.

How long can a Greek rental company wait before claiming for damage?

Civil Code art. 602 sets six months from the day the company took the car back. The period runs from the return, not from the date of the invoice. The Supreme Court applied this rule in ΑΠ 777/2022 to a claim brought later than six months.

Can a rental company in Greece charge my card after I returned the car?

A pre-authorisation at pickup is consent to block that amount, not to a later charge of a different amount. For a debit whose exact amount was not specified, you can ask your bank for a refund within eight weeks. An unauthorised debit must be reported without undue delay and at the latest within thirteen months.

Is a clause saying I received the car without damage binding in Greece?

Law 2251/1994 art. 2(7)(κδ) treats as abusive a term confirming that the consumer knows the condition of the goods when in fact they do not. A condition report you actually checked and signed is a different matter and still counts as evidence.

Where can I complain about a rental car charge in Greece for free?

The Consumer Ombudsman (Συνήγορος του Καταναλωτή) handles complaints about matters that arose within the last year and are not before a court. The European Consumer Centre of Greece sits within it. For cross-border rentals with Avis Budget, Enterprise, Europcar, Hertz or Sixt, the free ECRCS is another route.
