> Italian law presumes renter fault for damage during a rental, but the company must show when it happened and what it costs. Clauses, deadlines, free help.

## Short answer

In Italy the renter answers for damage that happens during the rental unless they prove a cause not attributable to them (art. 1588 Codice civile). The company still has to show the damage arose between pickup and return and prove its amount. Clauses that shift that proof, or impose excessive flat fees, are presumed unfair under the Codice del consumo.

## Before the due date

1. Dispute the claim in writing before the deadline in the claim letter, contesting both liability and the amount, without paying or signing any acknowledgement, and keep proof of the date you sent it.
2. Ask in writing for the check-out and return reports, photos with dates, itemised invoice and repair quotes: under art. 2697 Codice civile the company must prove the damage, when it arose and what it costs.
3. Challenge any clause that keeps you liable until a later inspection or shifts the burden of proof onto you: art. 33(2)(p) and (t) of the Codice del consumo presume such clauses unfair.

## Who has to prove the damage in an Italian rental?

Both sides carry part of the burden. The starting point is [art. 2697 Codice civile](https://www.normattiva.it/uri-res/N2Ls?urn:nir:stato:regio.decreto:1942-03-16;262~art2697!vig=): "Chi vuol far valere un diritto in giudizio deve provare i fatti che ne costituiscono il fondamento". The company claiming money has to prove the facts behind it: the damage, when it arose and what it costs.

[Art. 1590](https://www.normattiva.it/uri-res/N2Ls?urn:nir:stato:regio.decreto:1942-03-16;262~art1590!vig=) says you return the car in the same state you received it, "in conformità della descrizione che ne sia stata fatta dalle parti", save normal wear. The check-out form is that description. Without one, the law presumes you received the car in good repair. That makes pickup photos and a complete check-out form essential.

Then comes the rule that favours the company. Under [art. 1588](https://www.normattiva.it/uri-res/N2Ls?urn:nir:stato:regio.decreto:1942-03-16;262~art1588!vig=) the renter answers for deterioration during the rental "qualora non provi che siano accaduti per causa a lui non imputabile", unless you prove a cause not attributable to you. The Supreme Court's case summary of [Cass. n. 2619/2014](https://www.cortedicassazione.it/resources/cms/documents/Rassegna_civile_2014.pdf) requires "piena prova liberatoria" (full exonerating proof) for each damage found, and uncertainty about timing does not burden the lessor.

In practice the dispute turns on dates. The presumption covers damage "nel corso della locazione", during the rental. Handover records that fix the car's state at pickup and at return, or evidence that the damage dates from after return, are what counters it.

This only helps if you did not cause the damage. If you did, the amount can still be checked, for example a loss-of-use charge or a flat handling fee.

## Which rental clauses are void under the Codice del consumo?

Clauses that shift the burden of proof or impose excessive sums are presumed unfair ("vessatorie") until the company proves otherwise. [Art. 33(2) Codice del consumo](https://www.normattiva.it/uri-res/N2Ls?urn:nir:stato:decreto.legislativo:2005-09-06;206~art33!vig=) lists, among others:

- (f) a sum as damages or penalty "d'importo manifestamente eccessivo" (manifestly excessive);
- (p) clauses reserving to the company "il potere di accertare la conformità" of the service, the power to decide alone whether it was performed correctly;
- (t) "limitazioni all'adduzione di prove, inversioni o modificazioni dell'onere della prova", limits on evidence or reversals of the burden of proof.

In standard form contracts the company has to prove the clause was individually negotiated (art. 34(5)). Under [art. 36](https://www.normattiva.it/uri-res/N2Ls?urn:nir:stato:decreto.legislativo:2005-09-06;206~art36), unfair clauses are void while the rest of the contract stands, and "La nullità opera soltanto a vantaggio del consumatore e può essere rilevata d'ufficio dal giudice": the nullity only benefits the consumer and a judge can raise it on their own motion.

The authority AGCM has applied this to rental contracts. In [MS-CV20 (2014)](https://agcm.it/competenze/tutela-del-consumatore/dettaglio?id=c2f2498a-e87e-4491-90c4-0a4bbcc37c67&parent=Esiti+moral+suasion&parentUrl=%2Fcompetenze%2Ftutela-del-consumatore%2Fesiti-moral-suasion) it treated Avis and Sixt clauses that did not let the consumer prove a cause not attributable to them under art. 1588 as unfair under art. 33(2)(t). Keep in mind that AGCM findings are administrative, do not decide your individual case, and a company may have reworded its terms since. You can look up the current wording in our [rental terms lookup](https://rentalproof.eu/tools/rental-terms).

## Can they charge damage found after a key-box return?

They can try, but the company still has to show the damage arose during the rental. After a later inspection of a car that was moved, the burden under art. 2697 stays with the lessor. A clause keeping you liable until an inspection days after a key-box return can be challenged under art. 33(2)(p) and (t), because it lets the company alone fix the state at return and shifts the proof of timing. A signed return record (verbale di riconsegna) fixes the state when the rental ends. ECC-Net advises: "Make sure that a representative of the car rental company signs an acceptance form or indemnification statement" ([ECC-Net](https://www.eccnet.eu/consumer-rights/what-are-my-consumer-rights/travel-and-passenger-rights/road-travel-rights/car)).

## Is there a deadline for the rental company to claim?

No statutory inspection or notice deadline exists in Italy. Two rules still matter. Art. 1227(2) Codice civile: damages are not owed for losses the creditor could have avoided "usando l'ordinaria diligenza". And Avis, Europcar, Enterprise, Hertz and Sixt committed to EU consumer authorities that "Consumers will be provided with reasons and evidence of any damage, before the payment is taken" ([IP/17/86](https://ec.europa.eu/commission/presscorner/api/files/document/print/en/ip_17_86/IP_17_86_EN.pdf)). These are commitments, not statute.

The limitation period for contract claims is ten years (art. 2946). A court payment order (decreto ingiuntivo) must be opposed within 40 days, or 50 days if you live in another EU state ([art. 641 c.p.c.](https://www.normattiva.it/uri-res/N2Ls?urn:nir:stato:regio.decreto:1940-10-28;1443~art641!vig=)).

## How much can the company actually charge?

Only the actual loss. Art. 1223 allows "la perdita subita dal creditore come il mancato guadagno" insofar as they are an immediate and direct consequence. A court may estimate equitably only where the amount "non può essere provato nel suo preciso ammontare" (art. 1226).

Loss of use needs proof. The Supreme Court held in [Cass. n. 32946/2024](https://www.cortedicassazione.it/resources/cms/documents/Rassegna_mensile_DICEMBRE_2024__Settore_civile.pdf): "Il danno da fermo tecnico di veicolo non è 'in re ipsa', ma dev'essere provato", downtime damage is not automatic, it has to be proven.

In [PS12954 (2025)](https://www.agcm.it/media/comunicati-stampa/2025/10/PS12954), a long-term rental case, the AGCM fined ALD €5 million and found it aggressive to charge repairs for damage the customer only learned about at return because it was minor or not visible to the naked eye.

A penalty clause is owed regardless of proof of loss (art. 1382(2)), but a judge can reduce it if "manifestamente eccessivo" (art. 1384), and art. 33(2)(f) applies too.

## Fuel, cleaning and admin fees after return

Italy has the richest authority practice in Europe on flat handling fees for fines and tolls. The AGCM found unfair the Europcar clause charging "€ 56,00 (IVA esente) per pedaggio autostradale" and €45 for traffic offences ([CV229](https://www.agcm.it/dotcmsCustom/tc/2027/6/getDominoAttach?urlStr=192.168.14.10:8080/C12560D000291394/0/D8FAE6AD3347BF3FC12588600048ECFF/$File/p30175.pdf)), and a €50 plus VAT fee at Sicily by Car ([CV232](https://www.agcm.it/dotcmsCustom/tc/2027/6/getDominoAttach?urlStr=192.168.14.10%3A8080%2FC12560D000291394%2F0%2FB467C73987FC1B7CC12588600048ED03%2F%24File%2Fp30177.pdf)). In 2024 it fined Avis, Hertz, Centauro, Green Motion, Noleggiare and Drivalia over such fee clauses ([press release](https://www.agcm.it/media/comunicati-stampa/2024/5/CV242-CV243-CV244-CV245-CV247-CV248)).

For fuel and cleaning fees, the same tests apply: art. 33(1) and (2)(f), art. 36, and the facts on the check-out report, fuel receipts and interior photos at return. Extras added at the desk need your express consent under [art. 65](https://www.normattiva.it/uri-res/N2Ls?urn:nir:stato:decreto.legislativo:2005-09-06;206~art65); if consent was inferred from pre-ticked options, you are entitled to a refund.

## Can the company just debit my credit card?

Not without limits. Under D.Lgs. 11/2010 art. 12-bis, funds may only be blocked if you consented to a predetermined amount, and they must be released without delay once the exact amount is known. [Art. 13](https://www.normattiva.it/uri-res/N2Ls?urn:nir:stato:decreto.legislativo:2010-01-27;11~art13!vig=) gives a refund of a merchant-initiated debit where the authorisation did not specify the amount and the charge exceeds what you could reasonably have expected. Ask within eight weeks of the debit (art. 14). For an unauthorised transaction, notify your bank without delay and within 13 months (art. 9).

The [Visa rules](https://usa.visa.com/dam/VCOM/download/about-visa/visa-rules-public.pdf) require the merchant, within 10 business days of return, to document a delayed damage charge with an accident, police or insurance report and "at least 2 quotes". You may send an alternative estimate within 10 business days, and without agreement "the Cardholder may dispute the Transaction".

If your Italian card issuer rejects a written complaint or does not reply within 60 days, the [Arbitro Bancario Finanziario](https://www.arbitrobancariofinanziario.it/presentare-ricorso/verifiche-preliminari/index.html) takes cases within 12 months, up to €200,000.

## What if the claim goes to collections or court?

No rules specific to rental damage debts were found beyond the decreto ingiuntivo route. The Garante's credit information code covers credit reported by banks, financial intermediaries and private parties granting payment deferrals, not rental damage claims.

If you live in another EU country and the company directed its business there, [Regulation 1215/2012](https://eur-lex.europa.eu/legal-content/EN/TXT/HTML/?uri=CELEX:32012R1215) (arts 17 to 19) lets you be sued only in the courts of your domicile; contrary clauses have no legal force (art. 25(4)). Inside Italy, a forum other than the consumer's residence is presumed unfair (art. 33(2)(u)), and the giudice di pace hears claims on movables up to €10,000 (art. 7 c.p.c.).

## What to do now

1. Do not pay or sign an acknowledgement yet. Ask in writing for the signed contract, the terms in force, the check-out and return reports, photos with dates, the itemised invoice and repair quotes.
2. Gather your own evidence: pickup and return photos, the return record, fuel receipts, card statements.
3. Dispute any card debit you did not agree to, within eight weeks for art. 13 refunds.
4. If a decreto ingiuntivo arrives, note the opposition deadline that same day: 40 days, or 50 if you live in another EU state.

## Questions

### Do I have to prove I did not damage the rental car in Italy?

Partly. Art. 1588 Codice civile makes the renter liable for deterioration during the rental unless they prove a cause not attributable to them. But the company must first prove the damage arose during the rental, so the check-out form, the signed return record and your own photos are the key evidence.

### Can an Italian rental company charge damage found days after I returned the car?

No Italian statute sets an inspection deadline, but the company still carries the burden under art. 2697 of showing the damage arose during the rental. A clause keeping you liable until a later inspection after a key-box return can be challenged under art. 33(2)(p) and (t) of the Codice del consumo.

### Is a flat €50 admin fee for a traffic fine legal in Italy?

The Italian competition and consumer authority AGCM has found such flat fees unfair several times, including €56 and €45 fees at Europcar and a €50 plus VAT fee at Sicily by Car in 2022. These findings are administrative and do not decide your individual case, but the reasoning under art. 33(2)(f) applies to similar clauses.

### How long does a rental company in Italy have to claim damage?

Contract claims become time-barred after ten years under art. 2946 Codice civile, so waiting does not make the claim go away. If you receive a decreto ingiuntivo (court payment order), you must oppose it within 40 days, or 50 days if you live in another EU country.

### Where can I get free help with a rental dispute in Italy?

The European Consumer Centre network offers free legal assistance for cross-border cases; ECC Italy is in Rome. For cross-border rentals with major groups such as Avis, Europcar, Hertz, Enterprise or Sixt, the ECRCS conciliation service is free within 12 months of the company's final response.
