# Rental car damage claim in Austria: what the company has to prove

> Austrian law puts the burden of proof on the rental company, voids clauses that shift it to you and gives it one year to go to court.

## Short answer

In Austria the rental company has to prove that the damage arose during your rental; the fault presumption in § 1298 ABGB only applies after that. Clauses shifting the burden of proof to consumers are void under § 6 KSchG, and damage claims must reach a court within one year of return.

## Before the due date

1. Dispute the claim in writing before the deadline in the claim letter, contesting both liability and the amount, without paying or admitting fault, and keep proof of when you sent it.
2. Ask in writing for the check-in and check-out reports, original photo files with metadata, the first inspection date and the repair invoice: the company must first prove the damage arose during your rental (RS0022686).
3. Note the return date: under § 1111 ABGB the company must bring any damage claim in court within one year of the return, and invoices, reminders and collection letters do not stop that deadline.

## Who has to prove the damage in Austria?

The rental company does. Under [§ 1109 ABGB](https://www.ris.bka.gv.at/NormDokument.wxe?Abfrage=Bundesnormen&Gesetzesnummer=10001622&Paragraf=1109) you must return the car in the condition you received it, and under [§ 1111 ABGB](https://www.ris.bka.gv.at/NormDokument.wxe?Abfrage=Bundesnormen&Gesetzesnummer=10001622&Paragraf=1111) you are liable for damage you caused culpably, "nicht aber für den Zufall" (but not for chance events).

A rental company may point to § 1298 ABGB, which presumes fault against the debtor. The Austrian Supreme Court (OGH) limits that presumption to fault only. The company first has to prove the objective breach, including that the damage arose during your rental ([RS0022686](https://www.ris.bka.gv.at/Dokument.wxe?Abfrage=Justiz&Dokumentnummer=JJR_19751216_OGH0002_0050OB00200_7500000_003)). Your duty to show you were not at fault only starts once that causation is proven ([RS0021331](https://www.ris.bka.gv.at/Dokument.wxe?Abfrage=Justiz&Dokumentnummer=JJR_19900116_OGH0002_0050OB00658_8900000_003)).

To be fair to the other side: once it is established that the damage happened while the car was in your custody, § 1298 does put the proof of no fault on you (RS0125678). And the company cannot fill gaps with assumptions. Prima facie evidence "darf nicht dazu dienen, Lücken der Beweisführung durch bloße Vermutungen auszufüllen" (must not be used to fill gaps in the evidence with mere presumptions), RS0040287.

One honest limit: this only helps if you did not cause the damage. If you did, the amount can still be checked, see below.

## What if you returned the car to a key box?

The company has to inspect the car promptly, even without you present. The OGH reads § 1111 ABGB as obliging the lessor to inspect the returned object promptly and on its own initiative ([RS0020733](https://www.ris.bka.gv.at/Dokument.wxe?Abfrage=Justiz&Dokumentnummer=JJR_19910710_OGH0002_0010OB00023_9100000_001)). A gap of several days before the first inspection can weigh against the company.

A near-identical case was reported by [konsument.at](https://konsument.at/auto-transport/sixt-gmbh-schaden-nach-rueckgabe) in November 2011: key-box return, deductible claimed two weeks later, and the company argued the renter stayed liable until staff inspected the car. The consumer association VKI considered that clause grossly disadvantageous, and the case settled at 50%.

Check the company's current terms. Sixt's Austrian terms as published on 22 January 2026 contained no clause making the renter liable until inspection, limited consumer liability to fault, and named the consumer's domicile as the place of jurisdiction. You can look up the terms on file in the [rental terms lookup](https://rentalproof.eu/tools/rental-terms).

RentalProof's founder went through this in Graz: key-box return on a Sunday, an invoice for €1,320 three days later for two small scratches. The company's photos carried no metadata and showed the car in an underground garage, although it had been left on an outdoor lot. The claim was cancelled in writing less than 24 hours after his dispute letter. [Read the full case](https://rentalproof.eu/blog/sixt-1320-euro-invoice-cancelled-in-24-hours).

## Which rental terms are void under Austrian consumer law?

Clauses that move the burden of proof onto you are void. [§ 6 Abs 1 Z 11 KSchG](https://www.ris.bka.gv.at/NormDokument.wxe?Abfrage=Bundesnormen&Gesetzesnummer=10002462&Paragraf=6) invalidates a clause under which "dem Verbraucher eine Beweislast auferlegt wird, die ihn von Gesetzes wegen nicht trifft" (the consumer bears a burden of proof the law does not place on them). The OGH applies this to "fact confirmations" such as "vehicle taken over in proper condition" (RS0121955, RS0121433).

Further tools against unfair terms:

- **[§ 879 Abs 3 ABGB](https://www.ris.bka.gv.at/NormDokument.wxe?Abfrage=Bundesnormen&Gesetzesnummer=10001622&Paragraf=879):** a standard clause "ist jedenfalls nichtig, wenn sie unter Berücksichtigung aller Umstände des Falles einen Teil gröblich benachteiligt" (is void if it grossly disadvantages one party).
- **[§ 864a ABGB](https://www.ris.bka.gv.at/NormDokument.wxe?Abfrage=Bundesnormen&Gesetzesnummer=10001622&Paragraf=864a):** unusual, disadvantageous clauses you had no reason to expect do not become part of the contract unless they were specifically pointed out.
- **§ 6 Abs 3 KSchG:** a clause that is "unklar oder unverständlich abgefaßt" (unclear or incomprehensible) is ineffective.

In an association action, the Commercial Court of Vienna ([HG Wien 01.02.2011, 41 Cg 64/10k](https://verbraucherrecht.at/urteil-zahlreiche-klauseln-den-agb-von-buchbinder-rent-car-unzulaessig/2300)) found 30 of 33 clauses in Buchbinder's terms unlawful, including the condition confirmation and the damage-processing fee. Not everything falls, though: OGH 4 Ob 143/17h (24.08.2017) upheld a refuelling flat fee.

## How long does the company have to claim?

One year from return, in court. Under § 1111 ABGB the lessor must bring damage claims before a court within one year of getting the car back, otherwise the right is extinguished. Invoices, reminders and collection letters do not preserve the claim.

If you live in another EU country, the [Brussels Ia Regulation](https://eur-lex.europa.eu/legal-content/DE/TXT/HTML/?uri=CELEX:32012R1215) (Art 17(1)(c) with Art 18(2)) generally allows a company to sue you as a consumer only in your home member state.

Your own deadline is usually shorter in practice: reply in writing before the payment date on the invoice.

## How much can the company charge?

Only what it can show. A deductible is the ceiling of your liability, not a flat fee that falls due regardless of the repair. Ask for the repair invoice or a repair calculation, and question VAT billed on a repair that has not been carried out.

Flat amounts that work like a penalty can be cut: under [§ 1336 Abs 2 ABGB](https://www.ris.bka.gv.at/NormDokument.wxe?Abfrage=Bundesnormen&Gesetzesnummer=10001622&Paragraf=1336) the court "zu mäßigen" (shall reduce) an amount shown to be excessive. Claiming damages beyond such a penalty from a consumer requires an individually negotiated agreement (Abs 3).

## Fuel, cleaning and admin fees after return

Extra payments need your express consent. [§ 6c KSchG](https://www.ris.bka.gv.at/NormDokument.wxe?Abfrage=Bundesnormen&Gesetzesnummer=10002462&Paragraf=6c) says such an agreement "kommt nur wirksam zustande, wenn ihr der Verbraucher ausdrücklich zustimmt" (is only valid if the consumer expressly agrees). A pre-ticked option is not consent, and amounts paid without it must be refunded. This matters for cover added at the desk.

- **Refuelling:** a fee stated with its amount next to a full-to-full option is hard to attack as such (OGH 4 Ob 143/17h). Challenge the facts instead: the fuel level at return and your receipts.
- **Cleaning and damage-handling fees:** no verified Austrian decision is on file; argue § 879 Abs 3 ABGB and § 6 Abs 3 KSchG, backed by interior photos and the check-in report.
- **Fines handling fees:** the fee must be stated with its amount, reflect real handling cost and leave you free to contest the fine.
- **Price changes:** under § 6 Abs 1 Z 5 KSchG a higher price than agreed at booking is not binding unless the contract allows increases and decreases alike on justified grounds.

## The company already charged your card

Object in writing and involve your bank. If you did not authorise the debit, [§ 67 ZaDiG 2018](https://www.ris.bka.gv.at/NormDokument.wxe?Abfrage=Bundesnormen&Gesetzesnummer=20010182&Paragraf=67) requires your bank to refund it "spätestens bis zum Ende des folgenden Geschäftstags" (at the latest by the end of the next business day). Under [§ 65 ZaDiG 2018](https://www.ris.bka.gv.at/NormDokument.wxe?Abfrage=Bundesnormen&Gesetzesnummer=20010182&Paragraf=65) you must report it no later than 13 months after the debit. For a dispute with an Austrian bank over the debit itself, the [banking ombudsman](https://www.bankenschlichtung.at) is available.

## A collection agency is writing to you

A collection letter does not change the legal position. It does not preserve a damage claim under § 1111 ABGB, and under § 6 Abs 1 Z 15 KSchG you are only bound to pay collection costs if the agreement listed them separately and itemised. Dispute the claim in writing, with reasons, rather than ignoring it.

## Free help in Austria, and what happens in court

- **[Europakonsument](https://europakonsument.at)** (European Consumer Centre Austria) helps free of charge in cross-border cases. Renters from Germany contact the [EVZ Deutschland](https://www.evz.de/fragen-beschwerden/).
- **[VKI](https://vki.at)** offers consumer advice and brings association actions against unfair terms.
- **[Verbraucherschlichtung Austria](https://www.verbraucherschlichtung.at/antrag/)** is open to EU residents; company participation is voluntary.
- **ÖAMTC** (and ADAC for German members) provides legal aid to members.

If none of this resolves it, the company has to sue. It carries the burden of proving the damage arose during your rental, within one year of return.

## What to do now

1. Do not pay or sign anything yet. Note the payment date and the return date.
2. Collect your evidence: photos and videos with original files, the key-box confirmation email, fuel receipts.
3. Demand in writing: the terms in force, check-in and check-out reports, original photo files with metadata, the date of the first inspection, the repair invoice or calculation, and the card debit records.
4. Compare their documents with each other. In the Graz case, the cover letter and the invoice gave different damage dates.
5. Dispute in writing before the due date.

The [free Claim Check](https://app.rentalproof.eu/claim/new) reads your claim and shows its weak points, your next three steps and the deadlines that apply.

## Questions

### Do I have to prove that I did not damage the rental car in Austria?

Not at first. The rental company has to prove that the damage arose while you had the car. Only once that is established does § 1298 ABGB require you to show that you were not at fault. A clause in the terms that shifts this burden onto you as a consumer is void under § 6 Abs 1 Z 11 KSchG.

### How long can an Austrian rental company claim for damage after I return the car?

Under § 1111 ABGB the company has to bring its damage claim in court within one year of the return, otherwise the right is extinguished. Invoices, reminders and letters from a collection agency do not stop that deadline.

### I returned the car to a key box and the damage report came days later. What now?

The Austrian Supreme Court reads § 1111 ABGB as a duty for the lessor to inspect a returned car promptly on its own initiative, and a gap of several days before the first inspection can weigh against the company. Ask for the date and place of their first inspection, the original photo files and the key-box log.

### Is a signed note saying the car was taken over in proper condition binding?

Not as a burden-of-proof shift. Austrian case law (RS0121955, RS0121433) treats such fact confirmations in consumer contracts as void under § 6 Abs 1 Z 11 KSchG when they move the company's burden of proof onto the renter.

### The rental company already charged my card. Can I get the money back?

Extra payments beyond the rental price need your express consent under § 6c KSchG, and amounts taken without it must be refunded. If you did not authorise the card debit, § 67 ZaDiG 2018 obliges your bank to refund it by the end of the next business day; you have up to 13 months from the debit to report it.
