# How do I dispute a Sixt damage claim?

> What Sixt's own terms in Germany, Austria, Spain, Italy and France say about proof, damage amounts, fees and deadlines, and how to reply before you pay.

## Short answer

Dispute a Sixt damage claim in writing before paying and ask for the evidence: return protocol, original photos with metadata, repair invoice or expert report. Sixt's own terms help: in Austria Sixt has to prove the amount with invoices or a sworn expert's report, and in Germany renters are not liable for damage they are not responsible for.

## Before the due date

1. Dispute both liability and amount in writing to the address on the claim before the deadline in the claim letter, without paying or admitting fault, and in France request any counter-appraisal within 48 hours.
2. Ask Sixt for the signed or remote return protocol, the original photo files with metadata, the repair invoice or expert report, the appraisal cost, and the vehicle's movement and key-box log after your return.
3. Hold Sixt to its own terms: in Austria it must prove the amount with invoices or a court-sworn expert's report, and in Germany you are not liable for damage you are not responsible for.

## How Sixt handles damage found after return

Sixt records damage in a return inspection, and whether you are present depends on how you return. The French terms describe a joint inspection at return, recorded in a return protocol that you sign. If you use a key box, you are not there when the car is checked.

Sixt's Spanish terms spell this out. If you return outside opening hours, you accept that the return protocol "será realizado por el personal del arrendador sin su presencia" (will be carried out by Sixt staff without you being present), with a copy sent to you once the inspection is finished. The return time is the electronic reading of the drop box. Sixt's [help centre](https://www.sixt.com/help-center/sections/after-hours-and-late-returns/) says an after-hours return is processed "as soon as the SIXT location reopens" and that the final invoice follows by email within 48 hours of the return inspection. It also tells renters to photograph all four sides, the interior, mileage and fuel gauge "with a timestamp if possible".

The Austrian terms require return during the branch's usual business hours unless the rental agreement says otherwise. Neither the German nor the Austrian general terms contain a clause that puts the risk of damage between a key-box drop and the inspection on the renter.

## What Sixt's terms say, country by country

**Germany.** The [German terms](https://www.sixt.de/shared/t-c/sixt_DE_de.pdf) (section I.1) apply the general liability rules: "Demnach haften der Mieter und/oder Fahrer dann nicht, wenn sie die Pflichtverletzung nicht zu vertreten haben" (the renter or driver is not liable if they are not responsible for the breach). With a damage waiver you are liable up to the agreed excess per damage event; for gross negligence Sixt may cut the waiver in proportion to fault. The general terms set no damage calculation method and no damage handling fee. They authorise Sixt to debit the payment method from the rental agreement (section L.1), and state that Sixt will not take part in consumer arbitration (section N.2). In Germany the rental company has to prove the damage happened during your rental, see the [Germany guide](https://rentalproof.eu/damage-claims/germany).

**Austria.** The [Austrian terms](https://www.sixt.at/shared/t-c/sixt_AT_de.pdf) (section I.9) put the amount on Sixt: "SIXT wird die Höhe dieses Schadens durch Vorlage von Rechnungen oder durch Gutachten dafür qualifizierter (gerichtlich beeideter) Sachverständiger dem Mieter nachweisen" (Sixt will prove the amount to the renter with invoices or a report by a qualified, court-sworn expert). A flat €84 including VAT (€120 for a total loss) may be added only if the renter is at fault. If you dispute the calculation, you may get your own sworn expert within 4 weeks, and Sixt provides its expert's photos on request. If the real damage is below your excess, only the real damage is charged. For consumers, the reversal of the burden of proof for undeclared pre-existing damage does not apply, and the venue is the court of the consumer's domicile. In Austria, too, the rental company has to prove the damage happened during your rental, see the [Austria guide](https://rentalproof.eu/damage-claims/austria).

**Spain.** The [Spanish terms](https://www.sixt.es/shared/t-c/sixt_ES_es.pdf) (section D) say damage is valued by an independent expert chosen by Sixt or agreed by both parties, "en base a las tarifas vigentes de los talleres oficiales y precios de recambios publicados por los fabricantes" (based on current official workshop rates and manufacturers' published parts prices). The appraisal cost is charged to the renter, you have the right to a copy of the appraisal, and Sixt may also claim loss of use. Complaints go to service@sixt.es with the rental agreement number in the subject line. See the [Spain guide](https://rentalproof.eu/damage-claims/spain).

**Italy.** The [Italian terms](https://www.sixt.it/shared/t-c/sixt_IT_it.pdf) (section J) say the renter "risponde in conformità alle regole generali in materia di responsabilità civile" (is liable under the general rules of civil liability). With a damage waiver, the maximum charge per damage event is the excess in the price list in force when you rented. On top, the terms add a handling cost: €30 plus VAT for damage up to €500, €65 plus VAT from €500.01 to €1,500, and €90 plus VAT above that. For consumers, the competent court is the one where they live. Damage notifications go to damage-it@sixt.com. See the [Italy guide](https://rentalproof.eu/damage-claims/italy).

**France.** The [French terms](https://www.sixt.fr/shared/t-c/sixt_FR_fr.pdf) (article 12) say damage that does not stop the car being driven is appraised remotely "sur la base de photographies prises lors de la restitution du véhicule" (on the basis of photos taken when the car was returned). A counter-appraisal must be requested in writing to sinistre.france@sixt.com within 48 hours of receiving the expert report. Your liability may include repair costs set by an expert or invoiced by a garage and an immobilisation charge. See the [France guide](https://rentalproof.eu/damage-claims/france).

## Where Sixt damage claims are often weak

These points only help if you did not cause the damage. If you did, the amount can still be checked: repair invoice against estimate, fees, VAT and loss of use.

- **The custody gap.** After a key-box return, check the time of Sixt's inspection against the drop-box reading or the key receipt email. Anything found hours or days later was found while the car was in Sixt's hands.
- **Photos without metadata.** Check whether Sixt's photos show a date, time and place. In France the appraisal itself rests on photos taken at return, so their origin matters.
- **An estimate instead of an invoice.** In Austria, check whether Sixt actually sent invoices or a sworn expert's report, as its own terms promise. A bare amount or an excess billed as a flat sum is neither.
- **Fees above their own price list.** Check any handling fee against the terms: €84 in Austria only if you are at fault, the €30, €65 or €90 bands in Italy.
- **Their own terms against them.** Check deadlines and rights Sixt gives you: the 4-week expert period in Austria, the copy of the appraisal in Spain, the photos on request in Austria.

The founder of RentalProof had a €1,320 Sixt claim for two small scratches after a key-box return in Graz, Austria, cancelled in writing less than 24 hours after one letter. The [full story](https://rentalproof.eu/blog/sixt-1320-euro-invoice-cancelled-in-24-hours) shows how the documents were checked.

## How to respond to a Sixt damage claim

1. **Do not pay and do not admit fault.** Wait until you have seen the evidence behind the amount.
2. **Dispute in writing.** Reply by email to the address on the claim, keep a copy, and state that you dispute both liability and amount. Watch the short deadlines: 48 hours for a counter-appraisal in France, 4 weeks for your own expert in Austria.
3. **Request the evidence a solid claim would have.** Ask for the signed or remote return protocol, the original photo files with metadata, the repair invoice or expert report, the appraisal cost, and the vehicle's movement and key-box log after your return.
4. **Check your card statement.** If a damage amount has been debited that you dispute, tell Sixt in writing and contact your card issuer.
5. **Compare the claim with the terms.** Use the [terms lookup](https://rentalproof.eu/tools/rental-terms) to open Sixt's document for your rental country, and check fees and deadlines line by line.

## What to do next

Gather the claim, the rental agreement, your own photos and any Sixt emails sent at return. The five-question [self-check](https://rentalproof.eu/tools/is-my-claim-weak) shows which weak points apply. For a written assessment, the free Claim Check reads the claim, lists its weaknesses, sets out three next steps and checks your deadline.

## Questions

### Can Sixt charge my card for damage after I returned the car?

Sixt's German and Austrian terms authorise Sixt to debit the payment method named in the rental agreement for claims connected with the rental; the Austrian terms name damage claims and excess amounts expressly. That authorisation does not make a disputed claim correct. If a damage debit appears that you dispute, object to Sixt in writing and contact your card issuer about disputing the transaction.

### What is Sixt's damage handling fee?

In Austria Sixt's terms allow a one-off flat fee of €84 including VAT per damage event (€120 for a total loss), but only if the renter is at fault. In Italy the terms set a handling cost of €30, €65 or €90 plus VAT depending on the damage amount. Sixt's German general terms state no damage handling fee.

### How long do I have to challenge a Sixt damage calculation?

In Austria the terms give you 4 weeks to obtain your own report from a sworn expert if you dispute Sixt's calculation, and Sixt provides its expert's photos on request. In France you have to tell Sixt's claims department in writing within 48 hours of receiving the expert report if you want a counter-appraisal. Reply in writing as early as possible in any country.

### Who inspects the car if I return it to a Sixt key box?

Sixt's Spanish terms say that after an out-of-hours return the return protocol is done by Sixt staff without you, and a copy is sent to you afterwards. Sixt's help centre says an after-hours return is processed as soon as the location reopens. Photos you take at the drop-off, with a timestamp, are then your record of the car's condition.

### If I booked Sixt's damage waiver, do I still pay for damage?

Under Sixt's German terms you are liable up to the agreed excess per damage event, and Sixt can reduce the waiver in proportion to fault if the damage was caused by gross negligence. The Austrian terms add that if the actual damage is below the excess, only the actual damage is charged. The excess amount is stated in your rental agreement.

### Does Sixt take part in consumer arbitration?

Sixt's German terms say Sixt will not take part in dispute resolution before a consumer arbitration body. Sixt's Spanish terms point EU residents who rented in another EU country to the European Car Rental Conciliation Service (ECRCS) if they are not satisfied with Sixt's answer.
